Paralegal
PURPOSE
Perform legal analysis of Chapter 13 cases.
- Accurate and timely analysis of issues in compliance with Chapter 13 Trustee’s policies and procedures and the US Bankruptcy Code.
ESSENTIAL DUTIES
Evaluate and provide analysis of potential legal and case administration issues.
- Analysis is timely and accurate and to the satisfaction of the Chapter 13 Trustee and attorneys.
- Chapter 13 Trustee and attorneys have sufficient information to litigate cases.
- When appropriate, plans are confirmed and disbursement can commence.
Manage correspondence and communicate Trustee’s position on cases to debtors, creditors, and attorneys.
- Chapter 13 Trustee’s positions on issues are accurately conveyed to other parties.
- Possible litigation is limited by communicating regarding errors and conveying Trustee’s arguments.
Set up cases on system.
- Initial documents are correctly filed and uploaded to the system.
- All necessary documents are filed prior to confirmation hearings.
Send out first payment letters.
- Debtors are informed of accurate payment information.
- Checks are logged and scanned into the system.
Manage the Meeting of Creditor Calendar
- Cases are correctly set for hearings.
- Necessary documents are processed before hearing
- Necessary parties are noticed of hearing
Review and provide evaluations of complex legal documents, such as motions, court orders, and briefs.
- Chapter 13 Trustee and attorneys receive accurate descriptions of documents and legal arguments.
- Necessary adjustments are made in compliance with court orders to ensure proper disbursement.
Serve and file documents with court in compliance with office and court procedures.
- Documents are filed timely and accurately based on office procedures.
- Documents effectively communicate the Chapter 13 Trustees position.
Provide behind-the-scenes and in court support to Chapter 13 Trustee and Staff attorneys at Meeting of Creditors.
- Chapter 13 Trustee and staff attorneys have all necessary information regarding cases to convey arguments at hearings and conduct their duties.
- Ensure proper action is taken on the cases prior to the hearing.
- Cases are tracked to ensure items are resolved and necessary action is taken after the hearing.
- Notate hearing outcomes on pacer and provide copies of the hearing outcomes to the United States Trustee.
Adjust system data when amendments are filed based on office procedures.
- Data is adjusted accurately and timely to ensure proper disbursement.
- Issues with amendments are conveyed to necessary parties in a timely and accurate manner.
